Actually yes they were, they were only exclusive until February 2014. Read the fine print at the bottom of the page:

I didn’t buy mine off the MS store. Let’s dig up the similar disclaimer legal text on the color 10 figure and see what it says.
It’s not just the Microsoft store, it’s written on the back of the card itself. As for color 10 I highly doubt it has anything like that written.
Why would you doubt it? I’d be very surprised if the legal team at MS didn’t have this exact same clause inserted in the fine print related to color 10. They’d be crazy not too. You will find similar fine print associated with all the retailer exclusive DLC you see associated with preorders etc. too I’m sure. But that’s not the debate.
In either case the Jago card was marketed as exclusive - not “timed exclusive.” It’s not a legal debate about whether they are legally allowed to sell him. It’s about whether you can and should expect “exclusive” bonuses to remain exclusive. The reality is you can’t. And if it’s true for Shago then it’s true for color 10. You can say they should both stay exclusive of you can say they should both me made available for sale to the general public. But you can’t claim one should stay exclusive and the other shouldn’t just because it is convenient for you.
EDIT: the terms of reference for the ultimate source website (term 3) basically states anything you read on their website is not current and should not be used to support decision making. When you click on and actually buy the figures it doesn’t say anything about the color. So, legally they are in the clear. Anyone with a figure want to post a picture of the fine print on their code card?
EDIT 2: Actually, @SithLordEDP, we already have the proof that they have some fine print in operation. They have already broken the exclusivity for the Shago color 11 that is supposedly “exclusive” with the unlimited edition Shago. The idea that color 10 is protected by some other magic related to the limited edition Shago doesn’t seem legally or logically possible.
For those that are interested, I ran across this while I was browsing the web today.
I asked Ultimate Source about the color 10 codes yesterday before ordering a Shadow Jago figure and they replied with “All wave one figures come with color 10. The new shadow Jago comes with color 11.” So it sounds like you can still get color 10 from the Shadow Jago figure along with the new color 11.
I have my doubts on this but I hope that’s the case. I’m still kicking myself for not getting it when I had the opportunity. Oh well, I was able to get two figs while they were on sale so I can’t really complain.

I just got my Shago figure and I was indeed mistaken. It appears as if the new (not-limited edition) shago figures come with color 11 only. My apologies if I’ve mislead anybody, I misunderstood the tweet posted earlier. I’d be lying if I said I wasn’t a little bummed out about it but live and learn I guess.
It seems there are still some limited edition figures floating around on third-party collectible sites if anybody is still trying to get that color 10.
Color 10 is gone… if you can score a Limited Editor figure from someone..your in luck. but if Ultimate source is no longer selling that Limited Shago… color 10 is gone for good.

You can still get the LE Shadow Jago with Color 10 from BigBadToyStore, it’s where I got mine. My figure is #3893 of 5000 according to my collector card, I don’t know how much more have been sold since then but it’s still in stock according to the site.
Seems to be that way. It’s still accessible through a glitch but using it is impossible without the LE Code.
Standard Shago figure only comes with Color 11.
Maybe shadow lords will bring an exclusive color.

honestly i have wanted both skins but i dont care about them im fine with the lvl 50 skin which is what i have grinded for since i was level 1
